Bryan, Texas: door-to-door solicitor permit

• The answer: Yes — a solicitor's license from the city. Every solicitor must have one, and a solicitor includes all door-to-door sales persons calling on customers without appointment for retail sales (90-19, 90-20(a)). A company may take one license covering all its employees or agents, but must file each rep's name, address, date of birth, driver's license number and place of birth at least 48 hours before that rep sells; independent contractors need their own license (90-20(c)). Working without a current license is unlawful (90-24(a)).
• Where it comes from: The code says the city inspections department (90-20(a), (b)). The city's Vendor/Solicitor Licenses page says to apply online through the Citizenserve portal, choosing the "Vendor/Solicitor License" application type, with the articles of incorporation, a list of directors, partners and principals, and an ID document for each employee.
• Fee: The two sources disagree. The code sets $25.00 for a sole proprietor or business entity plus $3.00 for each individual who will have contact with the public (90-20(d)). The city's Vendor/Solicitor Licenses page says "Fee: $11 plus an additional $1 per person." Renewal after the first 30 days is a $10.00 renewal fee, and $1.00 per individual employee (90-21(b)). The application also requires a bond of not less than $250.00 (90-20(b)(19)).
• Hours you may knock: 8:00 a.m. to 8:00 p.m. — solicitors may conduct business only between those hours (90-22(h)).
• What the rep carries: The license, visibly shown by the person making door-to-door sales so the public can read it (90-20(g)). It is not transferable (90-20(h)).
• What takes the time: The license issues no later than ten days after a complete application is filed (90-20(e)). Each rep's details go in at least 48 hours before that rep sells (90-20(c)). The application asks for a sales tax number and permit, the company charter, and a sworn statement that each applicant has read Texas Business and Commerce Code ch. 39 on canceling consumer transactions (90-20(b)).
