Carlsbad, California: door-to-door solicitor permit

• The answer: The code has no door-to-door solicitor permit. Chapter 8.34, Solicitation, is conduct rules only: aggressive solicitation, motor vehicles and parking lots, posted signs and hours. Chapter 8.32, Vending and Soliciting, is a vending equipment permit for sidewalk vendors and food trucks. What the city does require is a Carlsbad business license before doing any business in the city (5.04.030), and the city's Business Licenses page says that includes businesses based in other cities that enter Carlsbad as part of their work.
• Where it comes from: Carlsbad Municipal Code Chapter 8.34, Solicitation. The business license comes from the Finance Department's business license office, 442-339-2495.
• Fee: No solicitor permit fee, because there is no solicitor permit. The business license tax is per company and runs on annual gross receipts. Section 5.08.015 sends "soliciting, vending or peddling regulated by Chapter 8.32" to Classification C: $25.00 plus 30 cents for each $1,000.00 of annual gross receipts, and never less than $30.00 (5.08.010(C)). That section dates from 1985 and Chapter 8.32 was rewritten in 2019 as a vending chapter, so which classification the office puts a door-to-door sales company in is a question for the office.
• Hours you may knock: Not before 8:00 a.m. or after 8:00 p.m. While the United States is on daylight saving time the hours are 8:00 a.m. to 9:00 p.m. The section covers commercial and noncommercial peddling, soliciting and canvassing on private property (8.34.060).
• What the rep carries: Chapter 8.34 names nothing. No badge, no ID card, no permit to show.
• What takes the time: The business license. The city's Business Licenses page says the current processing time is three to four weeks, and an invoice is sent once the application has been processed. No background check or fingerprinting for solicitors appears in Chapter 8.34.
