Davie, Florida: door-to-door solicitor permit

• The answer: Yes — a town permit and a business tax receipt. It is unlawful for a solicitor or peddler to work inside the town without first obtaining both (17-1.2(c)). The definition is wide: anyone who solicits or attempts to solicit orders for the sale of goods, wares, merchandise or services house to house, whether the sale closes in Davie or is approved elsewhere (17-1). The application names every individual who will be out knocking, each with a recent photograph, so plan on one line per rep (17-2(a)(3)).
• Where it comes from: The local business tax receipt clerk. Applications go to that clerk on the town's forms, sworn to or affirmed, and the business tax receipt office issues or denies the permit (17-2(a), 17-4). • Fee: A registration fee of $25.00 with every permit application, non-refundable even if the permit is denied, and the code says it is charged "in addition to applicable permit fees" (17-3). The business tax itself is not printed in the code: the town adopts a business tax rate schedule by resolution (13-18). So $25.00 is the floor, not the total — ask the clerk for the business tax line that fits door-to-door sales.
• Hours you may knock: 9:00 a.m. to the earlier of 9:00 p.m. or half an hour after sunset, each day — the code calls that the "reasonable time for uninvited solicitation" (17-1.2(a)). From late fall through winter the sunset half-hour is what ends the day, not the clock.
• What the rep carries: The permit, displayed conspicuously. It carries the signature and seal of the issuing town official, the permittee's name, address and recent photograph, the class of permit, the date of issuance, how long it runs, the permit number and a description of any vehicle used (17-5). Permits are nontransferable — a rep cannot borrow another rep's (17-6).
• What takes the time: Collecting the paperwork. The sworn application wants a recent photograph, mailing address and phone for the company, for whoever supervises the work, and for every person who will knock; a description of the activity and of anything handed out; the locations, dates and hours proposed; and a sworn statement that nobody named is registered as a sexual offender or sexual predator in Florida or any other state (17-2(a)). The code sets no processing deadline. A denied applicant gets the reasons in writing and an informal hearing with the town administrator (17-4).

• Worth knowing: A posted sign forbidding solicitation ends the call, and so does the occupant simply saying so — the right to solicit runs only where no sign forbids it and the occupant has not verbally forbidden it or asked the rep to leave (17-1.2(a)). Staying after being asked to leave is a code violation (17-1.2(b)). No peddler or solicitor may operate within 1,000 feet of the property line of a school, public-operated park or recreational facility in the town (17-9(a)). Roadway and intersection work is separately banned within 200 feet of intersections on eleven named roads, including Davie Road, Flamingo Road, Griffin Road, State Road 7 and University Drive (17-12.1). A permit expires at the end of the solicitation period or one year from issuance, whichever is less (17-4). Florida's own home solicitation sale permit (F.S. 501.022) is filed with the clerk of the circuit court — here, Broward.
