Miami Beach, Florida: door-to-door solicitor permit

Partly read: the permit answer is sourced, but the fee or the hours could not be read from the city’s own pages. The clerk questions below cover the gap.

• The answer: Yes — two documents. No home solicitation sales without (1) a home solicitation permit issued by the clerk of circuit court under F.S. 501.022 and (2) a City of Miami Beach Business Tax Receipt (74-2(b)). The state permit is issued to the individual as a laminated photo ID card, so it is per rep (F.S. 501.022(7)).
• Where it comes from: The state permit: the clerk of the circuit court for the county where the rep will sell (F.S. 501.022(2)). The Business Tax Receipt: the City of Miami Beach; applicants submit proof of the state permit, identification and fees (74-2(b)(2)).
• Fee: Section 74-2 names no amount. The city fee schedule lists "102-379(d) Business Tax Receipt Application 65.00" and a BTR decal at 12.00 (Appendix A); the business tax itself for a home-solicitation business is not named in 74-2. The state statute lets the county clerk set a reasonable permit fee (F.S. 501.022(2)); that fee was not read.
• Hours you may knock: Only between the hours of 9:00 a.m. and 7:00 p.m., Monday through Saturday; none on Sundays or legal holidays (74-2(c)).
• What the rep carries: The city BTR and the state permit, visibly displayed on the person at all times while soliciting (74-2(d)(4), (e)). State law also requires showing the permit to every prospective buyer before starting the pitch (F.S. 501.022(8)).
• What takes the time: The state permit: a sworn application with two recent color photos and fingerprints taken by law enforcement; the clerk sends them to FDLE and the sheriff, who report back within 60 days of receipt (F.S. 501.022(2), (3)). The permit is good for 1 year (F.S. 501.022(7)). No city processing time is published.

• Worth knowing: The city keeps a no solicitation list, updated monthly; reps must check it on the first of each month (or before starting mid-month) and skip listed addresses and any property with a "No Soliciting" sign (74-2(d)(3), (f)). Fines after one warning run one thousand dollars per day for a first offense and five thousand dollars per day after that (74-2(g)). Separately, peddling — carrying goods and selling and delivering them house to house — is unlawful except in areas the city manager approves (70-4).
