Miami Gardens, Florida: door-to-door solicitor permit

Partly read: the permit answer is sourced, but the fee or the hours could not be read from the city’s own pages. The clerk questions below cover the gap.

• The answer: The city code has no peddler, solicitor or canvasser chapter and no door-to-door registration. What Miami Gardens does require is a certificate of use for any business conducted for private profit "on or from any premises in the city," one per place of business (6-20, 6-21). A fiber crew with no premises in Miami Gardens is not obviously inside that definition, so call the Business Licensing office before the first day. Separately, Florida law requires a home solicitation sale permit from the clerk of the circuit court — here, Miami-Dade (F.S. 501.022).
• Where it comes from: Certificates of use are issued by the city manager or a designee, and the Building and Code Compliance department collects the fees (6-20, 6-24(1)). • Fee: No solicitor fee is published, because there is no solicitor permit. Certificate-of-use fees are not printed in the code either: 6-24(2) says they are "as prescribed in the revenue manual, which fees are on file in the city clerk's office," and may be changed by resolution. The revenue manual is not posted with the code, so ask the clerk for the current sheet.
• Hours you may knock: Miami Gardens publishes no knocking hours. There is no peddler or solicitor chapter to set them, and the miscellaneous offenses chapter has nothing on door-to-door calls. Treat that as unregulated until the city says otherwise, and ask before the team works after dark.
• What the rep carries: The code names nothing for a door-to-door rep. A business holding a certificate of use has to display it conspicuously at the place of business (6-28), which is a storefront rule, not a badge rule. Carry company photo ID as a matter of course.
• What takes the time: Nothing city-side for knocking itself. If the city decides a certificate of use is required, it comes with an application, a zoning-use check and an inspection of the business premises (6-20, 6-24(4)), and it expires every September 30 whatever month it was issued (6-22(a)). The state home solicitation sale permit goes through the clerk of the circuit court and takes its own time.

• Worth knowing: Selling from the public right-of-way is banned outright — no street vendors, and no selling goods, wares, services or merchandise from a cart, a vehicle or on foot in any right-of-way in the city (6-195(c)). Around Hard Rock Stadium the city draws a "clean zone" where canvassing, including handing out flyers and pamphlets, is prohibited during the clean zone period (6-195(c)(5)). Obstructing a street in order to solicit without a city permit is also unlawful (6-195(b)(2)). Those are street rules; knocking a residential door is a different activity and the code does not reach it.
