West Jordan, Utah: door-to-door solicitor permit

• The answer: Yes — a city residential solicitation license, plus a city-issued photo identification badge. It is unlawful to engage in, carry on or conduct the business of residential solicitation in the city without first obtaining a city business license and a city residential solicitation license (4-2F-1). The license is per rep: everyone who wants to knock doors files a completed application with the business license authority and holds a license before soliciting (4-2F-3). Soliciting at a private residence without one is flatly prohibited (4-2F-2).
• Where it comes from: The city business license authority. Identity is confirmed in person from a driver's license, passport, state identification card or United States military identification, so a rep goes to the counter (4-2F-4(C)).
• Fee: $108 per solicitor — the Solicitor line under Business Licensing in the city's Consolidated Fee Schedule. The code itself names no number; 4-2F-4(I) leaves the fee to the schedule the city council adopts. A company whose reps work here but which has no place of business in the city does not need a separate West Jordan business license, so long as it holds a valid local and/or state license where it does have a physical location (4-2F-10(C)). A company that does open a place of business here pays the business licensing fees instead: a $55 one-time application, a $163 base fee, and $8 per employee.
• Hours you may knock: It is unlawful for any person, licensed or not, to solicit at a residence before nine o'clock (9:00) A.M. or after nine o'clock (9:00) P.M., Mountain Standard Time, unless the solicitor has express prior permission from the responsible person (4-2F-15). The section names no days off.
• What the rep carries: Two things. The license, carried at all times while soliciting in the city, listing the solicitor's name, the responsible person or entity and the expiry date, dated and signed by the license officer (4-2F-7(A)). And the city identification badge, worn prominently on the person while soliciting, bearing the city's name, the solicitor's name, an address and phone number (the rep's or the company's), a recent photograph, and the expiry date (4-2F-7(B)). The license is not transferable (4-2F-9).
• What takes the time: The BCI check. Each applicant hands in an original or a certified copy of a BCI background check authorization plus a signed waiver letting the city run a name and date-of-birth BCI check; Utah residents bring a BCI report from a Utah law enforcement agency, and residents of other states bring one from a law enforcement agency in their home state or from the FBI (4-2F-4(G)). Also: in-person proof of identity (4-2F-4(C)), proof that the applicant or the company has registered with the state department of commerce (4-2F-4(D)), a special events sales tax number (4-2F-4(E)), any former names or aliases used in the last ten years (4-2F-4(B)), and evidence that the selling is for a bona fide "going business" with operations, assets and valid business licenses and state registrations — no certificate is issued to a solicitor who does not represent one (4-2F-4(K)). A license runs one year and expires at twelve o'clock (12:00) midnight on the anniversary of issuance (4-2F-6(B)).

• Worth knowing: The sign rule has teeth. An occupant posts a "No Solicitation" sign on or near the main entrance door, or near the property line by the sidewalk, and that display is legal notice (4-2F-13(A), (B)). Checking every residence for one is the solicitor's own duty, and knocking, ringing the bell or otherwise trying to get an occupant's attention at a posted house is a violation of the title (4-2F-14(A), (B)). It binds exempt solicitors as well (4-2F-13(D)). Asked to leave, leave immediately and peacefully (4-2F-14(D)). Repeated soliciting after a clear no is banned (4-2F-14(G)), and so is any ruse, deception or fraudulent concealment of the purpose to solicit (4-2F-14(C)). On a home solicitation sale the rep presents and gets signed a written buyer's right to cancel, good until five o'clock (5:00) P.M. on the third business day after signing (4-2F-16).
